Terms and Conditions 2022
The following clauses and the Booking Form will form part of the terms and conditions of this agreement (hereinafter called the ‘Conditions and Regulations), which the Hirer accepts having read and agreed them:
1. Definitions
“Boat” means the boat subject of this hire.
“Booking Form” means the form attached hereto.
“Company” means Moonraker Canalboats Limited of The Old Builders Wharf, Honeystreet,
Pewsey, Wiltshire, SN9 5PS
“End Date” means the date when the Hire ends as set out in the Booking Form. “Hire” means use of the Boat subject to the payment of the cost of hire. “Hirer” means the person hiring the boat as named on the Booking Form.
“Period of Hire” means the period between the Start Date and the End Date, during which the Hire takes place.
“Price” means the amount to pay for Hire set out in the Booking Form (including the deposit).
“Start Date” means the date when the Hire starts as set out in the Booking Form.
2. Bookings
2.1 All applications for the Hire must be made via the Booking Form. The booking becomes legally binding when Company provides the Hirer with an email confirmation (after receipt of the deposit). The Boat is booked when Company receives a 25% deposit of the Price. In the event of a cancellation the deposit or the Price is not refundable but the Boat can be rebooked for another date as set out in Clause 4 of these Conditions and Regulations. No show on the day will result in loss of all monies paid.
2.2 Any offer by Company to hold a reservation is not legally binding, unless the deposit has been paid by the Hirer.
2.3 In accepting a Booking Form, Company’s responsibility does not extend beyond the provision of the Boat and in particular there is no warranty that any particular route will be available for navigation during the Period of Hire. Where more than one Boat is booked on the same Booking Form each Boat shall be deemed to be the subject of a separate set of Conditions and Regulations.
2.4 Company reserves the right to refuse any application without stating their reason for doing so.
2.5 Company does not make any Hires for stag and/or hen group parties and/or any other type of parties.
2.6 The Hirer applying for the Hire must be over 25 years old and possess the legal capacity and authority to make the booking and accepts these Conditions and Regulations whether alone or on behalf of the persons when booking as a group. Company will only deal with the Hirer in all subsequent correspondence, including changes, amendments and cancellations.
2.7 The Hirer is responsible for ensuring the accuracy of the personal details or any other information supplied in respect of the Hirer and any other person(s) travelling on the Boat and for passing on any information regarding the Hire or any changes made in relation thereto, to all persons travelling on the Boat. The Hirer is also responsible for
paying the Price for the Hire and ensuring, including on behalf of other persons in the case of a group booking, compliance with these Conditions and Regulations. Notwithstanding the foregoing, Company may hold responsible and proceed against any of the persons travelling on the Boat during the Period of Hire on whose behalf the Hirer made the booking for the Hire.
2.8 The maximum number of persons allowed to participate in the Hire is as stated on the Booking Form.
2.9 Any variation or change to the terms of the Booking Form for the Hire must be made in writing to Company and agreed by Company in writing. Company reserves the right to refuse any variation or change in the terms of the Booking Form without stating their reason for doing so. Any variation or change agreed by Company will form part of the booking for the Hire and be bound by these Conditions and Regulations.
3. Prices
3.1 The Price to be paid by Hirer for the Hire is as stated on the Booking Form. Prices are inclusive of VAT and are subject to any change in the VAT rate prior to the settlement of the Price in full. Prices are in pounds sterling. Payment of the Price can be made by credit/debit card or bank transfer.
3.2 Upon submission of the Booking Form a deposit of 25% of the total Price for the Hire must be paid. The remaining sums due of the Price for the Hire must be paid no later than 12 weeks before the Start Date of the Hire. In the event that the sums due are not paid on the due date, then the booking will be cancelled and the deposit and any other relevant charges already paid will be forfeited. In the event that an application for the Hire is made than less 12 weeks before the Start Date of the Hire and accepted by Company the full Price of the Hire is payable forthwith.
3.3 Any changes in the Price by Company made after the booking will be communicated to the Hirer who may within 7 days of such notification withdraw the application for the Hire. Any sums of the Price already paid by the Hirer will be refunded subject to any administration charge as Company may reasonably determine.
4. Cancellation or Change of Hire
4.1 Cancellation or Change by Hirer
If, after the email confirmation of the booking has been issued, the Hirer wishes to change the Hire, such as but not limited to Period of Hire, Boat or route, Company with its best efforts will try make these changes, subject to availability. Any request for changes to be made must be in writing by the Hirer. The Price of the Hire may increase to reflect the changes requested by the Hirer. The Hirer will be asked to pay an administration charge of GBP 150.00 per booking amendment and any further cost Company incurs in making this change.
The Hirer may cancel the Hire at any time providing that the cancellation is made by the Hirer in writing. Notice of cancellation will be effective upon receipt by Company of the Hirer’s written communication. In the event of a cancellation by the Hirer, the deposit will be retained by Company. The Hirer will also pay any other cancellation charges as shown in the table below, unless it is successful in re-letting the Boat for the whole of the Period of Hire. These charges are based on how many days before the Hirer booked departure Company received Hirer’s cancellation notice. These charges are a percentage of the total Price for the Hire.

It is therefore strongly recommended that the Hirer protect him/herself against cancellation liability by taking out cancellation protection.
4.2 Cancellation or Change by Company
Notwithstanding any breach of these Conditions and Regulations by the Hirer, should the Hire be cancelled by Company at its own discretion, Company will refund any payments made, but shall not otherwise be liable and these Conditions and Regulations will be discharged.
Company may cancel the Hire in the event of Company itself being desirous of using the Boat (and where no suitable replacement is possible) which is the subject of the Hire for the purpose of an occasion of National rejoicing or mourning or for a purpose which in the opinion of the Company is of civic or national importance by giving to the Hirer notice of cancellation not less than 6 weeks prior to the Start Date. Company will refund any payments made but shall not otherwise be liable and these Conditions and Regulations will be discharged.
5. Force Majeure
5.1 Company will not be liable for any matters arising from any cause beyond Company’s reasonable control, such as but not limited to breakdowns, mechanical problems, defects, damage, restrictions or obstructions, repairs or damage to waterways, non-availability of routes, navigational works, storms, floods, droughts, ice, shortage of water or other weather conditions, shortage or non-availability of fuel, pandemic, war (hereinafter “Force Majeure).
5.2 In case of a Force Majeure event leading to cancellation, Company will retain the deposit or amount of the Price paid to date and subject to availability and as soon as reasonably practical, Company will arrange an alternative Hire of similar type and standard and/or similar time of year (though Company reserves the right to charge the Hirer any difference in price if the alternative is advertised at a higher price than the original Hire). If the alternative is not acceptable the Hirer must inform Company in
writing within 48 hours of being advised of the alternative and the deposit or amount of the Price paid to date will be forfeited and these Conditions and Regulations will be discharged.
5.3 The Hirer is recommended to take out personal and travel cancellation insurance cover.
6. The Period of Hire
6.1 The Hire will commence on the Start Date and finish on the End Date as stipulated in the Booking Form. Before the Hirer departs with the Boat Company will give the Hirer such instructions, demonstrations and trials as it thinks fit and require the Hirer to check and sign for the contents, inventory and the Boat acceptance entitled ‘Handover Document’.
6.2 Every effort will be made to have the Boat(s) available for the Start Date. If this is not possible due to circumstances beyond Company’s control, Company reserves the right to alter or curtail the Period of Hire. In the event that the Boat is not available because of circumstances beyond Company’s control as defined in Clause 5 of these Conditions and Regulations Company may substitute to a Boat of similar accommodation but if no such Boat is available Company shall refund any payments made, except for the deposit, but shall not otherwise be liable and these Conditions and Regulations will be discharged.
6.3 Company reserves the right to refuse a Hire without reason and recover hired Boats from unsuitable Hirers.
6.4 Company may repossess the Boat at any time during the Period of Hire if in the opinion of Company, the Hirer is unsuitable for the reasons on the grounds of age, inexperience, suspected influence of alcohol or drugs or any reason that may adversely affect the safety of any person, or commercial interests of Company, or if the Hirer is not behaving responsibly or if the Boat or any persons are at risk. In this event the Hirer shall remain liable to pay the Price for the Hire and no refund shall be due.
6.5 In the event of any repairs being necessary during the Period of Hire the Hirer must contact Company and under no circumstances should repairs be authorised without Company’s prior written consent.
The Boat shall be returned to Company and be vacated in a clean and tidy condition no later than the time specified on the End Date of the Hire. In return of the Boat on the End Date and following inspection of the Boat by Company, in the event that Company is satisfied that there is no apparent damage to the Boat on its return from the Hirer, no charges will be made to the Hirer. In the event that Company determines that accidental damage or loss was caused to the Boat and/or its contents during the Period of Hire, the Hirer will be liable to Company for all losses and damages arising from speeding, contact with a lock cill causing damage to the rudder, skeg or stern gear, TV aerials, chimneys, malicious or intentional damage to the Boat. Also excluded is malicious or intentional damage to other boats and property and the late return of the Boat and return of the Boat in unclean condition. The Hirer will indemnify Company or to third parties against all costs, damage, expenses, liability and claims howsoever arising from the negligence, neglect or default of the Hirer (or any other individuals joining the Hirer’s group named under the Booking Form).
In this instance Company reserves the right to charge, where applicable, part or all of the GBP 1000 to the Hirer.

6.6 Company reserves the right to charge the Hirer for a minimum payment of GBP 150 for a blockage to any toilet.
6.7 Late return of the Boat after the End Date will be charged an excess fee chargeable at GBP 150.00 per hour at Company’s discretion. It is Hirer’s responsibility to return the Boat on time and plan out the necessary navigation to return the Boat at the time requested on the End Date.
7. Subletting
The Hirer shall not sublet nor assign the Hire and/or the Boat or any part thereof without the prior written consent of Company. Should the Hirer do so or attempt to do so without the prior written consent of the Company, these Conditions and Regulations will be terminated and the Price paid retained by Company.
8. Hirer’s Responsibilities and Obligations
8.1 Hirer’s Property
8.1.1 Under no circumstances whatsoever will Company have any responsibility and/or liability in respect of any damage or theft or loss of any of the Hirer’s (or any other individuals joining the Hirer’s group) property, goods articles or things placed, deposited, brought on board or left on the Boat and the Hirer must indemnify and hold Company harmless in respect thereof. The Company may return the Hirer’s property left behind if claimed and following the receipt of payment for postage and packing (minimum charge GBP 10). Property not claimed within 2 months from the End Date will be disposed of by Company.
8.1.2 Vehicles may be left in Company’s car parks at the owner’s risk. Company will be under no liability for any loss of or damage to vehicles or contents of the Hirer (or any other individuals joining the Hirer’s group named under the Booking Form). The Hirer is particularly advised not to leave any valuable or portable items in their car. Company shall take such action as may be necessary to silence car alarms in Company’s car parks and to recover the costs from the Hirer.
8.2 Insurance and Indemnity
Company insures its Boat and its equipment against physical loss and damage and against public liability risks. Company’s insurance policy does not cover personal accidents or belongings of the Hirer (or any other individuals joining the Hirer’s group named under the Booking Form), the Hirer is strongly advised to check the level of its own personal and travel insurance.
8.3 Safety and Other Rules
The Hirer will comply and will ensure that other individuals joining the Hirer’s group will comply with the following rules at all times during the Hire of Period:
8.3.1 To ensure that at all times while the Boat is being navigated or is transiting locks the minimum age of the operator onboard and in charge is eighteen (18) years old.
8.3.2 Not to tow or be towed other than in exceptional circumstances.
8.3.3 To moor the Boat securely.
8.3.4 To supervise the Hire including the effective control of children the orderly and safe admission and departure of persons to and from the Boat and the orderly and safe clearance of the Boat in case of emergency.
8.3.5 To ensure all doors giving egress from the Boat shall be kept unfastened and unobstructed and immediately available for exit during the whole time the Boat are in use and no obstruction shall be placed or allowed to remain in any corridor giving access to the Boat.
8.3.6 Not to navigate after sunset or before sunrise.
8.3.7 To observe all speed limits, and not to navigate at a speed which creates a breaking wash or disturbs or inconveniences other waterway users.
8.3.8 Not to race the Boat.
8.3.9 Not to bring onto the Boat any dinghies, canoes, portable heaters, vehicles, lighting equipment, TV sets, electric tools or cooking appliances, inflammable liquids or substances, gas cylinders, car batteries, fire arms, portable medical equipment or any other items which might create dangers or hazards without Company’s prior written permission.
8.3.10 Not to smoke inside the Boat.
8.3.11 Not to use the Boat for any commercial purpose.
8.3.12 To allow the Boat to be occupied only by the persons named in the Booking Form.
8.3.13 Not to allow to be on the Boat at any time more than the maximum number persons allowed on board the Boat.
8.3.14 To give way to laden or unladen cargo boats, sailing craft, rowing boats and other human propelled craft.
8.3.15 Not to take the Boat on to sea or tidal waters without the written consent of Company. To cruise only on canals and rivers approved by the Company.
8.3.16 Not to have or carry any live bait on the Boat.
8.3.17 Not to drive any bolts, nails, tacks, screws, ‘blu tack’ into any part of the Boat nor shall any placards or other article be affixed thereto.
8.3.18 At all times to observe and abide by all regulations, bye-laws and navigational limits and abide by the instructions and advice of the relevant Navigational Authorities and Company and their respective officers and employees.
8.3.19 Company reserves the right at its reasonable discretion and without liability to restrict cruising areas or routes in the light of prevailing weather and/or navigation conditions and/or experience of the Hirer (or any other individuals joining the Hirer’s group named under the Booking Form who may be piloting the Boat).
8.3.20 If the Hirer is reported for improper navigation during the Period of Hire or if the Hirer is in breach of any of the rules set out above in Clause 8 and if Company has good reason to believe that it will be involved in any expense or penalty as a consequence, then, at the End Date, Company may charge against prospective future liabilities.
If no action has been taken after a maximum period of 6 months from the End Date Company shall return the full amount charged, to the Hirer.
9. Animals
Any animal to be carried during the Period of Hire will be at the discretion of Company and must be disclosed on the Booking Form. The first pet will incur a GBP 25.00 charge and GBP 10.00 for each additional animal thereafter.
10. Accidents and Complaints
10.1 Accidents
The Hirer is in charge of the Boat and is responsible for its safe navigation and return. In the event of any accident or damage to the Boat, or other craft or the waterway the Hirer must:
1. Obtain and record the name and registration number of the other boats and names and addresses of all parties involved including the other boat owners and other hirers.
2. Notify Company by telephone immediately with full details of the accident including damage incurred.
3. Not in any circumstances admit or allow other individuals on board the Boat to admit liability to any other person.
4. Not to carry out or have carried out repairs without the written consent of Company.
5. Obtain and follow Company’s instructions. In the event of an accident Company may repossess the Boat and the Hire, including these Conditions and Regulations, will then terminate without liability on Company. In the event that Company’s insurance cover is prejudiced or invalidated by any failure on the part of the Hirer to comply with the provisions of this condition the Hirer will indemnify Company in respect of all liability claims, loss, damage or expenses incurred. The Hirer is liable for and will indemnify Company against any claim or charge made by any Navigation Authority for damage to waterway property or loss of water.
10.2 Complaints
10.2.1 If the Hirer has a complaint while embarking on the Boat such as cleaning, missing inventory, linen or any other item, please notify Company before set off. In such case, Company will be able to help the Hirer immediately.
10.2.2 If the Hirer has a complaint in connection to the Hire, the Hirer must make his complaint in writing to Company within 24 hours of the event or subject matter of the complaint so that all reasonably possible remedial actions can be taken by Company. Failure to take these steps and give Company an opportunity to make things right at the time may significantly affect the Hirer’s ability to seek compensation later.
11. Service of Notices
Any notice, demand or request by Company to or upon the Hirer may be sent by ordinary pre-paid post addressed to the Hirer at the Hirer's address given in the Booking Form and on the Contact Page of this website, and shall be deemed to be made or served at the time when the letter containing the same would be delivered in the ordinary course of post.
12. Brochure
The specification of Boats, their accommodation, facilities and equipment in the brochure and/or on Company’s website is intended as a general guide but Company shall not be liable in the event of any differences in the boat supplied and reserves the right to make modifications. Layout plans are for guidance only and are not to scale and may have steps which are not shown. If the Hirer’s party includes any infirm persons, the Hirer should make relevant enquiries at the time of booking. Company reserve the right to change boat specifications without prior notice.
13. Entire Agreement
These Conditions and Regulations (including the Booking Form) constitutes the entire agreement between Company and the Hirer, and it supersedes all prior negotiations, representations and agreements, either oral or written, related to the subject matter hereof.
14. Third Parties
A person who is not a party to these Conditions and Regulations, will have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Conditions and Regulations.
15. Data Protection
To process your booking Company will need to collect and process personal information. This may, for operational reasons, be held overseas. For more detailed information about how Company uses personal information, please see the Company’s Privacy Policy.
16. Law and Jurisdiction
16.1 These Conditions and Regulations shall be deemed to have been made in England and shall be governed in all respects by English law.
16.2 Any dispute and/or claim arising in connection with these Conditions and Regulations should first be attempted to be settled by private negotiations between the Parties. If the Parties are unable to settle the dispute, within 90 days of its commencement, the dispute and/or claim will be finally settled under the exclusive jurisdiction of the Courts of England and Wales.

• Demographic information such as postcode, preferences and interests
• Financial information, such as bank card details, bank account details
• Insurance policy numbers and holder information
• Vehicle registrations.
What we do with the information we gather?
We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:
• Payment processing, deposits
• Car parking on-site
• Where our use of your information is necessary for us to perform the contract or contracts we have with you
• Where our use of your information is for the purposes of our legitimate interests
• Where we believe it is necessary to use your information to comply with a legal obligation to which we are subject
• Where we have your consent for: collect technical information such as data from cookies and similar technologies as below in our section “Cookie and Other Technology Policy”; use information about your location that we get from these technologies; use this information for marketing to you by email, text message and
other methods of electronic communication from time to time and in accordance to your data choice.
• Internal record keeping
• where our use of your information is for marketing and promotional purposes that you have consented to and to improve our products and services.
How long will we keep your personal information for?
We will keep your personal information for as long as is necessary for us to fulfil the purposes that we describe in this policy. After that, your personal information will be kept and securely stored for a further period of 12 months, following which we will then erase your personal information from our records and storage (unless there is a legitimate reason to maintain your personal information for longer).
Who will we share your information with?
We may share your information with other organisations and services providers that we work with or partner with from time to time in order to deliver the services to you, such as but not limited to:
• third party websites, navigational and canal authorities, emergencies and breakdown services, advertising and media companies to enable them to show you adverts or offers about our Company and services;
• our professional advisors and legal services;
• any law enforcement agency, court, regulator and government authority or any other third party we believe this is necessary to comply with a legal or regulatory obligation;
• any third party that purchases, or to which we transfer all or part of our assets and business to.
Will we transfer your information internationally?
Our business and company are located in the United Kingdom and in principle we will not need to transfer your personal information outside the territory of the United Kingdom. Should any law enforcement agency, court, regulator and government authority outside the United Kingdom request us your personal information, we will cooperate with the relevant authority and ensure the appropriate safeguards are in place to protect the personal information we have to transfer.
What are your rights and controls over your personal information?
You have a number of rights and controls, such as you can decide to opt-out from receiving any marketing or promotional materials from us or restrict us in way we use your personal information.
However, please note that some of your choices or changes may limit our ability to provide you with our services or maintain your account with us. If this is the case, we will notify of it.
You have the right to request at any time or to update in your account on our website:
• access and update your personal information such as contact details, financial details etc.;
• opt-out of any marketing or promotional communications;
• details on your booking.
You may choose to restrict, object, update or delete the collection or use of your personal information in the following ways:
• Whenever you are asked to fill in a form on the website, look for the box that you can click to indicate that you do not want the information to be used by anybody for direct marketing purposes.

We will not sell, distribute or lease your personal information to third parties.
